Working Time Agreement For Teachers


Unregulated working time is working time in which an employee is “responsible for the allocation of his or her own working time”, taking into account work tasks, unless this is hindered for operational reasons. A department head or equivalent determines when operational reasons require attendance at the workplace. Teachers can opt for regular working hours at their own request. Principals are responsible for recruiting teachers. In the absence of teachers (e.g. B in the case of short-term absence, of teachers suffering from persistent illness or of teachers on maternity leave), there are no special regulations for their replacement. The amount of remuneration (allowances) for overtime of all employees is determined at the central level, namely by the Labour Code. The details of the system of collective bargaining and other wage conditions for teachers in public schools are set out in the Government Ordinance on Wage Conditions for Public Service and Administrative Workers and the Government Ordinance on the Labour Catalogue. Schools are legal entities and a change in another school is not possible. An employee can only change schools at his choice and after having fulfilled the conditions set by the new employer. If teachers change within the teaching profession, they do not have the right to retain their salary rights – the payment can only correspond to the valid salary scale. There are no specific forms of support for groups of children or facilities for children under 3 years of age, but if the facilities are run by a public or governmental organization, their employees may benefit from cultural and social needs or special compensation described below for teachers.

Among other incentives for teachers, it also includes the possibility of granting employees a special salary payment (remuneration completely outside the pay system) in order to improve their work with employers, e.B. on a birthday. Employers can list these opportunities and specify the amount of compensation granted in the internal rules or agree with the unions in the collective agreement. Another body that deals with labour law issues is the Labour Inspectorate (in accordance with the Labour Inspection Act). However, the Labour Inspectorate is not responsible for the settlement of labour disputes. They may be dealt with by a mediator approved by mutual agreement between the parties. A similar mechanism applies to collective bargaining disputes. The tribunal represents the last instance and, in most cases, is the only body that can resolve the dispute. Teachers have unregulated working hours in accordance with a local working time agreement. Individual teachers will apply their professional judgment regarding assignment prioritization. In exercising their professional judgment, teachers must take into account the objectives set at the school, local and national levels.
